Allgemeine Geschäftsbedingungen

1. Allgemein

Die folgenden Bedingungen gelten für die Regelung von Angebot, Kaufabwicklung, Versand, Zahlungsmöglichkeiten und Kündigungsrecht, der von www.handmadegingerbread.com angebotenen Produkte. Die allgemeinen Geschäftsbedingungen sind auf Deutsch, Italienisch und Englisch verfasst. Alle auf www.handmadegingerbread.com angebotenen Produkte werden direkt durch die Crumble Srls, Justinaweg 13, I-39057 Eppan an der Weinstraße (BZ), eingetragen in der Handelskammer Bozen unter der REA-Nr. BZ-237961, MwSt-Nr. 03170830214 vertrieben. Weitere Informationen erhalten Sie telefonisch unter der Nummer: +393499783051 oder per Mail info@handmadegingerbread.com. Die Handelsaktivität auf elektronischem Weg der Crumble Srls richtet sich ausschließlich an Konsumenten, welche den geltenden Gesetzen und Regelungen des elektronischen Geschäftsverkehrs entsprechend. Unter „Konsument“ versteht sich jedwede Person, welche sich auf unserer Seite www.handmadegingerbread.com privat aufhält, d.h. ohne kommerzielle, professionelle oder unternehmerische Ziele zu verfolgen. In den vom „Konsumenten“ abweichenden Fällen, bitten wir Sie, sich mit uns über die folgende Email-Adresse in Verbindung zu setzen: info@handmadegingerbread.com.

2. Registrierung 

Um einen Kaufvertrag abzuschließen, kann fakultativ ein Kundenkonto auf www.handmadeingerbread.com erstellt werden. Um die kostenlose Registrierung durchzuführen, muss das entsprechende Formular mit Name, Nachname, Adresse, E-Mailadresse, Telefonnummer und Passwort vervollständigt werden. (Folgend nur noch „Registrierungsdaten“ genannt). Die Registrierungsdaten dürfen nur vom registrierten Nutzer verwendet und nicht an Dritte weitergegeben werden. Der Nutzer garantiert, dass die bei der Registrierung angegebenen Daten komplett, korrekt und der Wahrheit entsprechend sind. Um den Registrierungsprozess abzuschließen ist es notwendig, dass der Kunde bestätigt, die Privacy-Bestimmungen bezüglich des Umgangs mit den persönlichen Daten durch die Crumble Srls gelesen zu haben und damit einverstanden zu sein. Die Crumble Srls hat das Recht aus Gründen der eigenen Diskretion die Registrierung von jeglichem Kunden abzulehnen, sowie Accounts und alle zugehörigen Daten zu löschen, falls diese illegal, verleumdend gegenüber der Crumble Srls und/oder dessen Produkten und/oder Dritten, sowie allgemein beleidigend, verleumdend, oder in irgendeiner Form illegal sind.

3. Kaufvertrag

Um einen Kaufvertrag abzuschließen, muss der Kunde das entsprechende Bestellformular in elektronischer Form ausfüllen und telematisch Crumble Srls zukommen lassen, indem er den auf der Seite Schritt für Schritt erscheinenden Anweisungen folgt. Der registrierte User kann die Ausstellung einer Rechnung für den Kauf verlangen. In diesem Fall müssen die nötigen Informationen zur Vervollständigung der Rechnungsdaten (Mehrwertsteuernummer und Steuernummer) eingegeben werden. Der Kunde kann eine von der Rechnungsadresse abweichende Lieferanschrift angeben und bestimmen ob es sich bei der Ware um ein Geschenk handelt. Vor Abschluss des Kaufvertrags erscheinen alle Informationen bezüglich der zu bestellenden Waren, des Gesamtpreises (inklusive Steuern, zusätzlichen Versandkosten, eventuellen Zollabgaben, sowie jeglichen anderen unter Umständen anfallenden zusätzlichen Gebühren) und das Widerrufsrecht. Außerdem werden vor der Weiterleitung der Bestellung folgende Informationen zusammengefasst: Die verschiedenen technischen Schritte für den Vertragsabschluss; die Art der Archivierung des abgeschlossenen Vertrags und die entsprechenden Zugangsmöglichkeiten zur Verbesserung falsch eingegebener Daten und Alternative Sprachen (neben Italienisch) zum Abschluss des Vertrags. Vor dem Abschicken des Vertrags wird der Kunde dazu aufgefordert, die Allgemeinen Geschäftsbedingungen und die weiteren Informationen auf www.handmadegingerbread.com zu akzeptieren, inklusive der Privacybestimmungen. Das Absenden der Bestellung bedeutet die Verpflichtung des Kunden der Zahlung des Gesamtbetrags nachzukommen. Der Kaufvertrag gilt als abgeschlossen, wenn die Crumble Srls das Bestellformular registriert, und die Korrektheit der entsprechenden Bestell- und Zahlungsdaten überprüft hat. Mit dem Abschluss des Kaufes wird der Kunde eine Email von der Crumble Srls mit den folgenden Informationen erhalten: Die Bestellbestätigung, inklusive einer Zusammenfassung allgemeiner Bedingungen, Informationen bezüglich der erworbenen Produkte, Angaben zum Gesamtpreis (inklusive Versand- und eventuell anderer anfallender Kosten), angegebene Zahlungsmethode und dem Widerrufsrecht. Es empfiehlt sich die Bestätigungsemail aufzubewahren. Alle von der Crumble Srls zum Kauf angebotenen Produkte werden nur in die im Bestellformular angegeben Länder verkauft und versandt. Nicht in dem Bestellformular vorhandene Länder können nicht ausgewählt werden und damit kann die Bestellung nicht vollzogen werden. In diesem Fall, um die Bestellung abzuschließen, muss eine Email an info@handmadegingerbread.com mit der Angabe der gewünschten Produkte und Lieferadresse gesendet werden, die Crumble Slrs wird ihre Email beantworten und ihnen die Informationen zur Vervollständigung des Kaufes mitteilen. Die Crumble Srls hat das Recht in gewissen Fällen den Verkauf zu verweigern falls zum Zeitpunkt der Bestellung die geforderten Produkte nicht verfügbar sind oder dem Käufer nicht das nötige Vertrauen entgegen gebracht wird. In diesen Fällen sieht die Crumble Srls vor, den Kunden auf elektronischen Postwegen in Kenntnis zu setzen, dass der Kaufvertrag nicht zum Abschluss gekommen ist, begründet das Vorgehen und schlägt alternative Lösungsmöglichkeiten vor. Im Falle, dass bestellte Produkte zum Zeitpunkt der Bestellung nicht mehr verfügbar sein sollten, ist es die Aufgabe der Crumble Slrs, eventuelle nicht verfügbare Waren zu melden und alternative Produkte mit gleichem oder höherem Wert vorzuschlagen. Alternativ dazu sieht Crumble srls die Rückerstattung schon ausgeführter Zahlungen vor. Für die Verbraucherstreitfälle, die sich aus diesem Vertrag im Zusammenhang mit dem Onlineverkauf von Waren und Dienstleistungen zwischen Crumble Srls und einem Verbraucher/einer Verbraucherin ergeben, garantieren wir bereits jetzt unsere Teilnahme an der Prozedur zur alternativen Streitbeilegung bei der ADR-Stelle „Onlineschlichter.it“: Zwölfmalgreiner Str. 2 39100 Bozen (BZ) Tel. 0471-975597 Fax 0471-979914. Die Beschwerde an Onlineschlichter.it kann über die Website www.onlineschlichter.it eingereicht werden. 4. Waren

Die Produkteigenschaften der Waren der Crumble Srls sind in den speziellen Produktbeschreibungen auf der Seite www.handmadegingerbread.com sichtbar. Die bildlichen Beschreibungen, Fotos und Farben der abgebildeten Produkte können vom tatsächlichen Produkt abweichen, auch abhängig von dem verwendeten Internetbrowser oder Monitor.

5. Preise 

Alle angegeben Preise der angebotenen Produkte verstehen sich inklusive der in Italien angewandten Mehrwertsteuer. Die Versandspesen sind separat im Bestellformular angegeben und variieren je nach Land der Bestellung. Die Spesen eventuell anfallender Steuerkosten, Zölle und anderer Abgaben durch das Zielland der Spedition, werden ebenfalls separat im Bestellformular angegeben und hängen vom gewählten Zielland ab.

6. Zahlung

Folgende Zahlungsoptionen stehen zur Verfügung:

Zu Gunsten der Crumble Srls, Raiffeisenkasse Unterland Gen. (Filiale Leifers, Kennedystraße) IBAN: IT62M0811458480000300008176, BIC RZSBIT21017, mit dem Nachnamen des Kunden und der Bestellnummer als Zahlungsgrund.

Alle für die Transaktionsabwicklung nötige Daten werden über verschlüsselte Protokolle an den Zahlungsdienst Paypal übertragen, ohne das es Dritten möglich ist auf die Daten zugriff zu haben. Die Crumble Srls hat ausschließlich Zugriff auf diese Daten, um Kauftransaktionen und Rückerstattung - Transaktionen durchzuführen.

7. Versand und Zustellung

Lieferungen innerhalb Italien werden voraussichtlich an Werktagen zugestellt, meist nach zwei bis vier Werktagen ab Abschluss des Bestellvorgangs und der Bestätigung des dazugehörigen Zahlungseingangs. Für Versand außerhalb Italiens ist mit Lieferzeiten von fünf bis neun Werktagen ab Abschluss der Bestellung und des Geldeingangs zu rechnen. Im Falle der Bezahlung mittels Überweisung ist zu beachten, dass bis zur Bestätigung des Geldeingangs meist zwei Werktage vergehen. Für den Versand arbeitet die Crumble Srls mit nationalen sowie internationalen Speditionsunternehmen zusammen (BRT, UPS, PosteItaliane und Weitere), welche die vollständige Verantwortung für die Lieferung übernehmen; von der Warenabholung bis zur Übernahme durch den Empfänger. Im Falle der Zustellung eines Paketes von Crumble Srls, welches über äußerlich erkennbare Beschädigungen (Dellen, Löcher, Flecken,…) durch den Kurier verfügt, muss der Empfänger den Empfang des Paketes auf dem Lieferschein mit der Unterschrift „Mit Vorbehalt – con riserva“ quittieren. Im Falle des Erhalts von beschädigter oder defekter Ware, muss der Empfänger den Sachverhalt per Mail an die E-Mailadresse info@handmadegingerbread oder telefonisch an die Nummer +393499783051 innerhalb von 14 Tagen nach Erhalt der Sendung melden.Die Crumble Srls sieht es vor, den Käufer zu kontaktieren, um den Austausch der beschädigten Waren oder die Rückerstattung des Kaufpreises, eventuell mittels Gutschein, zu vereinbaren. Die Crumble Srls behält sich vor, von Käufern, welche angeben defekte oder beschädigte Ware erhalten zu haben, eine genaue - auch fotografische - Dokumentation einzufordern, welche die angegeben Schäden belegt. Eventuell anfallende Versandspesen durch zu ersetzende Waren werden von der Crumble Srls übernommen. Der Käufer selbst ist verantwortlich für den Wertverlust von Ware durch unsachgemäßen Gebrauch. Ausgenommen sind unvermeidbare Beeinträchtigungen durch unbedingt notwendigen Maßnahmen zur Feststellung des intakten Zustands besagter Ware. 

8. Widerrufsrecht

Nach der Regelung des ges. Dekrets 206/2005 hat der Käufer das Recht, ohne Angabe von Gründen und ohne Strafzahlung, innerhalb von 14 Tagen nach Erhalt der Ware vom Kaufvertrag zurückzutreten, indem er eine schriftliche Erklärung an die Crumble S.r.l.s. mittels Email an info@handmadegingerbread.com oder per Post an Crumble Srls, Justinaweg 13, I-39057 Eppan an der Weinstraße (BZ). In der Rücktrittserklärung müssen die einzelnen Produkte angegeben werden, bei welchen sich der Käufer auf das Widerrufsrecht beruft, mit Bestellnummer- und Datum.

Vorlage für das Widerrufsschreiben:

WIDERRUFSFORMULAR (im Sinne des Art. 49, Absatz 1, Buchstabe h) des GvD Nr. 206/2005)

Im Falle des legitimen Gebrauchs des Widerrufsrecht, muss der Käufer ohne Verzögerung, und in jedem Fall innerhalb von 14 Tagen nach der Rücktrittserklärung vom Vertrag, die gekauften Waren an folgende Adresse zurückgeben oder senden: Crumble Srls, Justinaweg 13, I-39057 Eppan an der Weinstraße (BZ).

Die Kosten des Rückversands gehen zu Lasten des Käufers, auch in Fällen von Verschwinden oder Beschädigung der Ware vor und/oder durch den Versand. Die Crumble Srls sieht vor, im Falle des legitimen Gebrauchs des Widerrufsrechts durch den Käufer, eventuell schon kassierte Summen zu erstatten. Die Rückerstattung erfolgt sofern technisch möglich in derselben Zahlungsmethode wie die ursprüngliche Zahlung. Die Rückerstattung erfolgt nach Erhalt und der Prüfung auf Unversehrtheit, um dem Käufer die Unversehrtheit und die Übereinstimmung des Produkts mit der Bestellung zu bestätigen. Die Zurückzahlung erfolgt sobald wie möglich, spätestens innerhalb 14 Tagen nach erhalt der Mitteilung.

9. Privacy

10. Angewendet Gesetze und gerichtliche Zuständigkeit

Die allgemeinen Geschäftsbedingungen der Crumble Srls sind durch das italienische Gesetz und insbesondere den Gesetzesdekreten des 6. September 2005 n. 206 c.d., und 9. April 2003 n70 c.d. geregelt. Der Verkauf der Produkte geschieht in Italien und unterliegt den geltenden Gesetzen der Republik Italien. Zuständiges Gericht ist einzig und allein das zum Moment des Vertragsabschlusses legislativ geltende.

11. Änderungen und Aktualisierungen

Die allgemeinen Geschäftsbedingungen Crumble Srls können im Laufe der Zeit auf Grund von Veränderung der Bedürfnisse des Betriebs, des Marktes oder der Gesetze, angepasst werden. Jede Veränderung wird auf der Seite www.handmadegingerbread.com veröffentlicht und gilt ab dem Veröffentlichungsdatum.

Le presenti condizioni di vendita regolano l’offerta, l’accettazione, la spedizione, le modalità di acquisto e di recesso dall’acquisto, dei prodotti offerti sul nostro sito www.handmadegingerbread.com. Le condizioni generali di vendita sono redatte in italiano, tedesco ed inglese. Tutti i prodotti acquistati su www.handmadegingerbread.com sono venduti direttamente dalla Crumble Srls, con sede legale in Via Santa Giustina 13, I-39057 Appiano sulla Strada del Vino (BZ), Nr. REA BZ-237961, C.F. e P.IVA n. 03170830214. Qualunque altra informazione può essere richiesta direttamente alla Crumble Srls, scrivendoci una e-mail all’indirizzo info@handmadegingerbread.com o telefonicamente al numero +393499783051.

2. Registrazione

Per concludere il contratto di acquisto di uno o più prodotti offerti su www.handmadegingerbread.com è possibile effettuare la registrazione e creare un account sul sito www.handmadegingerbread.com. La registrazione al sito è gratuita. Per registrarsi l’utente deve compilare il modulo di registrazione, inserendo proprio nome, cognome, indirizzo, un indirizzo e-mail, numero di telefono ed una password (di seguito, per brevità, le “Credenziali di Registrazione”). Le Credenziali di Registrazione devono essere utilizzate esclusivamente dall’Utente Registrato e non possono essere cedute a terzi. L’Utente Registrato garantisce che le Credenziali di Registrazione fornite durante la procedura di registrazione al sito sono complete, corrette e veritiere. Al fine di completare la procedura di registrazione l’utente dichiara di aver preso visione dell’ Informativa sulla Privacy ai sensi del Regolamento UE 2016/679 ("GDPR") e di prestare il consenso al trattamento dei dati personali da parte della Crumble Srls. Crumble Srls si riserva la possibilità di rifiutare, a propria esclusiva discrezione, la registrazione di qualsiasi utente, nonché il diritto di eliminare gli account, e tutti i dati relativi, in caso siano rilevati contenuti illeciti, lesivi dell’immagine della Crumble Srls e/o dei suoi prodotti e/o di terzi, o comunque contenuti offensivi, diffamanti, o comunque illegali.

3. Contratto di vendita

Per concludere il contratto di vendita di uno o più prodotti offerti sul sito, l’Utente dovrà compilare un modulo d’ordine in formato elettronico e trasmetterlo Crumble Srls, in via telematica, seguendo le istruzioni che compariranno di volta in volta sul Sito e che accompagneranno le diverse fasi dell’acquisto. L’Utente Registrato può indicare un indirizzo di spedizione diverso da quello di fatturazione e specificare se l’acquisto è un regalo. Prima che l’Utente Registrato inoltri l’ordine di acquisto vengono comunicate le informazioni relative alle caratteristiche del Prodotto acquistato, l’indicazione dettagliata del prezzo totale (comprensivo delle spese aggiuntive di spedizione e ogni altro costo, compresi eventuali tasse, dazi ed imposte applicabili nel paese di destinazione del prodotti), il diritto di recesso. Prima dell’inoltro dell’ordine sono altresì fornite le seguenti informazioni: le varie fasi tecniche da seguire per la conclusione del contratto; il modo di archiviazione del contratto concluso e le relative modalità di accesso; modalità di correzione degli errori di inserimento dei dati; le lingue a disposizione per concludere il contratto oltre all’italiano. Prima di inoltrare l’ordine di acquisto l’Utente Registrato sarà invitato a dichiarare di accettare e conoscere le Condizioni Generali di vendita e le ulteriori informazioni contenute nel sito www.handmadegingerbread.com, compresa  l'informativa sul trattamento dei dati sul sito chiamato "Privacy Policy". L’inoltro dell’ordine implica l’obbligo di pagare il prezzo totale comunicato. Il contratto è da considerarsi concluso quando la Crumble Srls registra il modulo d’ordine, previa verifica della correttezza dei dati relativi all’ordine e del pagamento. Una volta effettuato l’acquisto, Crumble Srls  trasmetterà via e-mail una ricevuta dell’ordine d’acquisto, contenente un riepilogo delle condizioni generali, le informazioni relative alle caratteristiche del Prodotto acquistato, l’indicazione dettagliata del prezzo totale (comprensivo dei costi di spedizione e dei tributi applicabili ed di ogni altro eventuali costo), del mezzo di pagamento utilizzato, del diritto di recesso. Si raccomanda di conservare l’e‐mail di ricevuta come prova d’acquisto o di memorizzarla su supporto durevole. Tutti i prodotti offerti dalla Crumble Srls sono venduti e consegnati solo nei paesi individuati nel modulo d’ordine di acquisto. Paesi non presenti nella lista non possono essere selezionati nella procedura di compilazione del modulo d’ordine e l’ordine di acquisto non potrà essere inoltrato. In tal caso, al fine di effettuare l’acquisto, dovrà essere inviata una e-mail al seguente indirizzo e-mail info@handmadegingerbread.com specificando i prodotti che si intendono acquistare ed il paese in cui si vuole effettuare la consegna; sarà Crumble Srls a rispondere alla e-mail e fornire le indicazioni per concludere l’acquisto. Crumble Srls si riserva di rifiutare o comunque non dare corso ad ordini d'acquisto in caso di indisponibilità dei prodotti o per ordini che non diano sufficienti garanzie di solvibilità. In questi casi Crumble Srls provvederà ad informare per posta elettronica l’Utente Registrato che il contratto non è concluso e non è stato dato seguito all’ordine d'acquisto specificandone i motivi ed eventualmente suggerendo una possibile soluzione. Nel caso in cui i prodotti presentati sul sito non siano più disponibili o in vendita al momento dell'invio del modulo d'ordine, sarà cura della Crumble Srls comunicare prontamente all’Utente Registrato l'eventuale indisponibilità e suggerire altri possibili prodotti, di valore commerciale pari o superiore all’ordine; in alternativa la Crumble Srls provvederà al rimborso del pagamento eventualmente effettuato. 4. Oggetto della vendita 

Le caratteristiche essenziali dei prodotti offerti dalla Crumble Srls sono presentate con apposite schede prodotto, visibili direttamente sul sito www.handmadegingerbread.com. Le immagini ed i colori dei prodotti offerti in vendita potrebbero tuttavia non essere corrispondenti a quelli reali a causa del browser Internet e del monitor utilizzato.

5. Prezzo 

I prezzi dei prodotti offerti sono tutti IVA inclusi (IVA applicabile in Italia). Il costo di consegna è riportato separatamente nel modulo d’ordine e dipende dal Paese di spedizione dei prodotti. Il costo di eventuali tasse, dazi ed imposte applicabili nel Paese di destinazione dei prodotti è riportato separatamente nel modulo d’ordine e dipende dal Paese di spedizione dei prodotti.

6. Pagamenti

Le modalità di pagamento sono le seguenti:

3) Bonifico:

A favore della Crumble Srls, Cassa Raiffeisen Bassa Atesina Soc. Coop. (Filiale di Laives, Via Kennedy) IBAN: IT62M0811458480000300008176, BIC RZSBIT21017, indicando il nome e cognome aggiungendo il numero dell'ordine come causale del bonifico.

Tutte le informazioni finanziarie necessarie per la transazione saranno trasmesse tramite protocolli crittografati a Paypal, che fornisce i relativi servizi di pagamento elettronico a distanza, senza che terzi possano avervi accesso. Dette informazioni non saranno utilizzate dalla Crumble Srls se non per completare le procedure inerenti l’acquisto dei beni commercializzati tramite il Sito e per emettere i relativi rimborsi in caso di eventuali restituzioni dei prodotti.

7. Spedizione e consegna

Crumble Srls consegna i propri prodotti esclusivamente a destinatari nel rispetto delle normative vigenti nel paese in cui viene effettuata la consegna. La consegna indicativamente avviene nei giorni feriali, in due - quattro giorni lavorativi dalla data di inserimento dell'ordine sul sito della Crumble Srls con relativo pagamento. In caso di consegna da effettuarsi in un paese diverso dall’Italia la consegna avviene indicativamente in cinque – nove giorni lavorativi dalla data di inserimento dell'ordine sul sito della Crumble Srls con relativo pagamento. Nel caso di pagamento tramite bonifico bancario, la consegna avverrà con la stessa tempistica, di cui sopra, ma a partire dalla data di conferma del trasferimento dei fondi. Crumble Srls effettua la consegna attraverso i migliori corrieri nazionali ed internazionali (Bartolini, UPS ecc.), che si assumono la piena responsabilità della consegna dalla presa in carico presso la nostra azienda, fino alla consegna all’indirizzo di spedizione indicato nell’ordine di acquisto. In caso di consegna di pacchi dalla Crumble Srls visibilmente danneggiati dal corriere, rotti e/o macchiati, il destinatario deve accettare il pacco danneggiato firmando la bolla del corriere "Con Riserva". Nel caso di consegna di merce danneggiata, o comunque difettosa, l’acquirente dovrà segnalare la circostanza mediante comunicazione scritta all’indirizzo e-mail info@handmadegingerbread.com o al numero telefonico +393499783051 entro 14 giorni dal ricevimento. Crumble Srls provvederà a contattare l’acquirente per concordare la sostituzione dei prodotti danneggiati o la restituzione del prezzo di acquisto, eventualmente anche per mezzo di buoni sconto. Crumble Srls si riserva di richiedere all’acquirente, che denunci di aver ricevuto merce danneggiata e/o difettosa, la presentazione di documentazione, anche fotografica, che provi il danno. Le eventuali spese di spedizione della merce sostitutiva sono a carico della Crumble Srls. L’acquirente è responsabile della diminuzione del valore dei beni risultante da un utilizzo diverso da quello necessario per stabilire le caratteristiche del bene acquistato. Qualora Crumble Srls constati l’esistenza del difetto segnalato, essa provvederà alla sostituzione della merce ovvero ad emettere in favore dell’acquirente un buono sconto, pari o superiore al valore del prodotto difettoso, da utilizzarsi per l’acquisto di altro prodotto disponibile sul sito.

8. Recesso

Secondo la disciplina del D.Lgs. 206/2005, l’acquirente/consumatore ha diritto di recedere dal contratto di acquisto dei prodotti, senza alcuna penalità, entro 14 giorni dal ricevimento della merce, previa comunicazione scritta da inoltrare alla Crumble Srls al seguente indirizzo e-mail info@handmadegingerbread.com ovvero tramite lettera raccomandata con ricevuto di ritorno al seguente indirizzo: Crumble Srls, Via Santa Giustina 13, I-39057 Appiano sulla Strada del Vino (BZ), ove dovranno essere indicati i prodotti o il prodotto per i quali si intende esercitare il diritto di recesso, il numero e la data dell’ordine. Al fine di esercitare correttamente il diritto di recesso l’acquirente è invitato ad utilizzare il seguente modello:

 In caso di legittimo esercizio del diritto di recesso l’acquirente senza ritardo, ed in ogni caso entro 14 giorni dalla data in cui ha comunicato la decisione di recedere dal contratto, deve restituire i beni acquistati alla Crumble Srls, Via Santa Giustina 13, I-39057 Appiano sulla Strada del Vino (BZ). Le spese di restituzione della merce saranno a carico dell’acquirente, ivi compresa la responsabilità in caso di smarrimento o danneggiamento dei prodotti. Crumble Srls, in caso di legittimo esercizio del diritto di recesso, provvederà a rimborsare all’acquirente le eventuali somme già incassate dallo stesso. Il rimborso avverrà utilizzando lo stesso mezzo di pagamento usato dall’acquirente per la transazione iniziale. Al fine di procedere al rimborso la Crumble Srls dovrà aver previamente ricevuto in restituzione i prodotti e verificato con esito positivo, da comunicare all’acquirente via posta elettronica con la conferma di accettazione dei medesimi, la loro integrità e conformità all’ordine. Il pagamento del rimborso verrà quindi eseguito dalla Crumble Srls il prima possibile e comunque entro i 14 giorni successi all’invio della suddetta mail di accettazione.

10. Legge applicabile e foro competente

Le Condizioni Generali di Vendita della Crumble Srls sono regolate dalla legge italiana ed in particolare dal decreto legislativo 6 settembre 2005 n. 206, c.d. codice del consumo, con specifico riferimento alla normativa in materia di contratti a distanza e dal decreto legislativo 9 aprile 2003 n. 70 su alcuni aspetti concernenti il commercio elettronico. La vendita di prodotti avviene nel territorio dello Stato Italiano ed è sottoposta alle leggi vigenti nella Repubblica Italiana. 1. Introduction 

The following General Terms of Business apply to the product offering, sales, shipment, modes of payment and right of withdrawal for products available from www.handmadegingerbread.com. 2. Registration

To enter into a purchase agreement, the user has the possibility to register and open a customer account at www.handmadegingerbread.com. There is no charge for registration, which involves filling in the appropriate form with your given name, surname, address, e-mail address, telephone number and a password (hereinafter called “registration data”). The registration data may only be used by the registered user and may not be communicated to third parties. The user is responsible for ensuring that his/her registration data are complete and correct. To complete the registration process, the customer must confirm that he/she has read and accepts the Privacy Rules pursuant to EU Regulation 2016/679 ("GDPR") governing the use of personal data by Crumble Srls. Crumble Srls has the right, at its own discretion, to refuse any customer registration and to delete any accounts and all appurtenant data that are illegal, defamatory of Crumble Srls and/or its products and/or third parties or generally insulting, defamatory or in any way illegal.

3. Purchase agreement

To conclude a purchase agreement, the registered customer must fill in the appropriate order form electronically and e-mail it to Crumble Srls by following the step by step instructions provided on the website. The registered user is entitled to receive an invoice for his/her purchase on request. In that case he/she must supply the data required to complete the invoice (VAT and tax numbers). The customer may provide an invoice address that differs from the delivery address and can also specify whether the goods have been ordered as a present. Before finalizing the purchase agreement, the relevant information concerning the goods to be ordered is displayed together with the total price (including taxes, shipping charges, customs duties where applicable and all other additional costs that may be incurred) and notice of the customer’s right of withdrawal. Before the order is forwarded, the following information is also displayed: the various steps for conclusion of the agreement, the mode of archiving the concluded agreement and the steps to be taken to correct any mistakes and to select alternative languages to Italian to conclude the agreement. Before the agreement is sent, the customer is requested to accept the General Terms of Business and other information provided on www.handmadegingerbread.com including the Privacy Policy. By sending the order, the customer undertakes to pay the total amount. The purchase agreement is considered to have been concluded when Crumble Srls has registered the order form and verified the correctness of the order and payment data. On conclusion of the agreement, the customer will receive from Crumble Srls an e-mail containing the following information: confirmation of the order, including a summary of the General Terms of Business, information on the purchased products, the amount of the total price (including shipment and any other costs incurred), the selected method of payment and the notice of the customer’s right of withdrawal. Customers are recommended to save the mail with the order confirmation. The products offered for sale by Crumble Srls can only be sold and shipped to the countries listed on the order form. Countries that are not listed on the order form cannot be selected and orders to such countries cannot therefore be placed. In such cases, customers are asked to send an e-mail to info@handmadegingerbread.com specifying the required products and the delivery address. Crumble Srls will reply with the information needed to proceed with the order. Crumble Srls has the right to refuse an order if the required product is not available at the time of ordering or if Crumble Srls does not have the necessary confidence in the customer. In such cases, Crumble Srls will send an e-mail to the customer stating that the purchase agreement has not been concluded, explaining the reasons and suggesting alternative solutions. Where the products ordered are not available at the time of ordering, Crumble Srls shall communicate the fact and suggest alternative goods of the same or a higher value. As an alternative, Crumble Srls will refund the corresponding payments already made. The characteristics of the products available from Crumble Srls are specified in the individual product descriptions to be found on www.handmadegingerbread.com. The visual properties, photographs and colors may differ from the actual products, also depending on the browser or monitor used.

5. Prices

All prices of the products offered are quoted inclusive of Italian VAT. Shipping charges are listed separately on the order form and vary from country to country. Any taxes, customs duties and other charges relating to the destination country are also listed separately on the order form and vary from country to country.

6. Payment

7. Shipment and delivery

Crumble Srls only ships products to customers that observe the relevant legal provisions in the destination country. In Italy, deliveries are normally made on working days, usually two to four working days following conclusion of the purchase order and receipt of confirmation of the corresponding payment. Shipments to other countries usually take between five and nine working days following conclusion of the purchase order and receipt of payment. Please note that, in cases of payment by bank transfer, it usually takes two working days for confirmation of payment to arrive. For shipment and delivery, Crumble Srls cooperates with the best national and international forwarding agents (BRT, UPS and others). They have complete responsibility for the shipments, from collection of the goods to delivery to the consignee. In the case of delivery of a package from Crumble Srls that bears visible signs of damage (dents, holes, stains, etc.), the recipient must write “Accepted with reservation” when signing for it on the delivery note. In the case of damaged or defective goods, the recipient must communicate the details within 14 days of receipt by sending an e-mail to info@handmadegingerbread.com or calling +393499783051. Crumble Srls will contact the customer to arrange for replacement of the damaged goods or a refund of the purchase price, possibly in the form of a voucher. Crumble Srls reserves the right to require customers who report the receipt of damaged or defective goods to provide evidence, including photographs, in support of their claims. Any additional shipment costs incurred for replacing the goods will be borne by Crumble Srls. The customer is responsible for any damage to the goods caused by improper use or handling except for unavoidable damage resulting from measures needed to determine the condition of the goods concerned. 

8. Right of withdrawal

Pursuant to Decree no. 206/2005, the purchaser/customer has the right to withdraw from the purchase agreement within 14 days of receipt of the goods, without stating a reason and without incurring any penalty, by addressing a written declaration to that effect to Crumble Srls in the form of an e-mail sent to info@handmadegingerbread.com or a letter to Crumble Srls, Via Santa Giustina 13, I-39057 Appiano sulla Strada del Vino (BZ). The declaration of withdrawal must specify the individual products, with order numbers and dates, for which the customer wishes to take advantage of the right of withdrawal.

In the case of legitimate use of the right of withdrawal, the customer must act without delay and within 14 days at the latest to return the purchased goods to the following address: Crumble Srls, Via Santa Giustina 13, I-39057 Appiano sulla Strada del Vino (BZ).

The cost of the return shipment is at the costumers expense. That also applies in case goods go missing or are damaged prior to or during the shipment. In the case of legitimate use of the right of withdrawal by the customer will be refunded by Crumble Srls the corresponding payments already received. Refunds will be made using the method of payment used by the customer to make the originary payment. For such refunds, Crumble Srls must first receive the returned products and verify that they are not damaged. The customer will then receive confirmation that the goods correspond with the order sent and are not damaged. The refund will be made as soon as possible and within 14 days from the date of the last e-mail sent.

10. Legal basis and legal domicile

The General Terms of Business of Crumble Srls are based on Italian law, in particular on the Decrees of 6 September 2005 no. 206 c.d. and 9 April 2003 no. 70 c.d. The products are sold in Italy, and sales are subject to the relevant provisions of the law of the Republic of Italy. In the case of any dispute arising from a purchase agreement or sale, that court of law shall have jurisdiction that was competent when the agreement was concluded.

11. Amendments and updates

As a result of changes in the company’s needs or on the market or to relevant laws, these General Terms of Business may be modified in the course of time. All such changes shall be published on the company’s website at www.handmadegingerbread.com and shall come into effect on the date of publication.
